UK Nationals Living in France – Latest Residency Update 21/08/19

Latest updates on residency for UK nationals living in France.

Information for UK Expats Living in France Post-Brexit

If you’re an expat living in France and wish to remain there post-Brexit, here are some key points you should know from the UK government website:

Brexit Timeline and Residence Permit Requirements

Brexit is set to take place on 31st October 2019. After this date, UK nationals will need to obtain a new type of residence permit according to their situation. This also applies to:

  • UK nationals who have already applied for French nationality.
  • UK nationals married or in a civil partnership with French nationals.

Deal vs. No-Deal Brexit

The outcome of Brexit will depend on whether the UK leaves the EU with a deal or without a deal:

  • If a deal is negotiated, UK nationals living in France will have until mid-2021 to apply for the new residence card.
  • If there is no deal, UK nationals will be granted a grace period of one year to obtain the new residence card. Applications must be submitted within the first six months (from the day of Brexit).

Regardless of whether you already have a European ‘carte de séjour’ (residence permit), you will still need to apply for the new residence card.

Residence Card Categories in a No-Deal Scenario

If there is no deal, the type of residence card you will receive depends on your personal situation. The categories specified by France are:

  1. UK nationals living in France for five years or more.
  2. UK nationals living in France for less than five years who fall under one of the following categories:
    • Salaried worker with a Contrat à Durée Indéterminée (CDI).
    • Salaried worker with a Contrat à Durée Déterminée (CDD).
    • Self-employed.
    • Graduated in France in the past year, or worked for at least three months, and are now looking for work or starting a business.
    • Students.
    • Family members of UK nationals who qualify under one of the above categories.
  3. UK nationals living in France for less than five years but who do not meet any of the above categories.

Residence Card Costs and Formalities

If there is no-deal Brexit, the application for a residence card will cost €119, according to the UK government website. UK nationals who already hold a permanent ‘carte de séjour’ and have lived in France for at least five years will be able to exchange their card for the new one with fewer formalities.
